General Terms and Conditions

§ 1 Scope

These General Terms and Conditions apply to all orders placed by consumers via the online shop "Project TiMa" of TiMa Artist UG (haftungsbeschränkt).

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

§ 2 Contracting Party

The purchase contract is concluded with:

§ 3 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding online catalog.

By clicking the "Buy Now" button, the customer submits a binding offer to conclude a purchase contract.

The confirmation of receipt of the order is sent by e-mail immediately after the order has been placed and does not yet constitute acceptance of the contract.
The contract is only concluded by an express declaration of acceptance or by shipping the goods.

§ 4 Prices and Shipping Costs

All stated prices are final prices and include the statutory value-added tax.

In addition to the stated prices, shipping costs may apply. These will be shown separately during the ordering process.

§ 5 Payment

Payment is made via the payment methods offered in the online shop (e.g., Shopify Payments, PayPal, credit card, etc.).

§ 6 Delivery

Delivery will be made to the delivery address specified by the customer.

The delivery time is specified in the respective offer.

§ 7 Retention of Title

The goods remain the property of TiMa Artist UG (haftungsbeschränkt) until full payment has been made.

§ 8 Right of Withdrawal

Consumers generally have a right of withdrawal.

§ 9 Exclusion of the Right of Withdrawal for Personalized Products

A right of withdrawal does not exist for contracts for the delivery of goods,
which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer (§ 312g Abs. 2 Nr. 1 BGB).

This applies in particular to personalized prints, stickers, posters or individualized letters with names.

§ 10 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
